Jim - Texas law requires that all parties be notified that it is an intermediary situation in writing. You do not have to participate in dual agency and that is your choice.

I don't dislike inter-office intermediary, as long as everyone gets their disclosures. I think it's the only form of dual agency that can be done properly. For this reason I don't tell agents in my office about my listings other that what is common publicly available knowledge. It keeps the door open that one of those agents can represent a buyer without any knowledge of my seller's position or confidential information.

I just discovered that a property in Fair Oaks Ranch is being listed by an agency that my buyers agent works for. Not a.good thing as I now have to be very careful what I tell this agent.

Richard - Buyer agency didn't even exist in Texas until the late 80s. I think dual agency (intermediary) needs to be stuck down.

Mathieu - A buyer can purchase property without an agent (and a seller can sell without it as well). Engaging directly with the agent though can be a bad decision as they represent the seller - and therefore anything you say to them is not covered by confidentiality.

Us appears to have a rather complex system in respect of the property market. Some aspect I understand and if time is of essence a broker is a great option. However, I personally like to seek properties and engage directly with agent. Is this permitted in the USA?

Dual agency is common in many countries. Australia has one representative for both buyer and seller. This is supported with a very strict legislation and methods of practice. I have often believed that single agents would be a great option and it is pleasing to observe that this is beginning to occur.
