Lawsuit Filed Against Pulte/Centex Homes Over Slope Failure
It didn’t take long.
Much as expected and predicted, a resident of the Rivermist subdivision, has filed a lawsuit against Pulte and Centex Homes in regards to the recent slope failure at the Hills of Rivermist community. Homeowners Luis and Janice Jimenez, filed suit Thursday citing negligence, lack of disclosure, and fraud.
I expect this to be the first shot in what could easily become a long battle. With so many homeowners affected in the Rivermist and Hills of Rivermist subdivisions, this isn’t going to go away for Centex Homes and Pulte. Recent conversation revolved around whether residents could sue, as the Centex purchase agreements contained a forced binding arbitration clause (which I will cover soon – arbitration has it’s place in Texas real estate law, but many people are now terrified of this word), but it appears that the residents and their lawyers have decided there’s a way to go about it and proceed.

I actually came across the “Lawsuit Filed Against Pulte” blog article when doing a bit of legal research and ended up reading a few others in your blog too… including this one. A symptom of a wandering mind, I’m afraid!
